Lori Vallow Daybell claimed that she had an alibi at the time of her children’s murders in a court document filed by her attorneys on Thursday, Jan. 5.

According to the paperwork, Vallow was in her Rexburg apartment with Melanie Gibb, David Warwick and/or Chad Daybell when her children died in Alex Cox’s, Vallow’s brother, apartment in Rexburg.

Her attorneys, Jim Archibald and John Thomas wrote, “Lori Vallow was in Hawaii when Tammy Daybell died at the home of Chad Daybell in Salem, Idaho. Defendant was with Melani Boudreaux and/or Audrey Barattiero.”

Vallow and Chad Daybell have been married since Nov. 5, 2019, two weeks after the death of Daybell’s wife, Tammy Daybell.

They are co-defendants in the murders of J.J. Vallow and Tylee Ryan. Both children had been last seen in September 2019, until their bodies were found buried in shallow graves on Daybell’s property in June 2020.

The same day the alibi was filed, Archibald and Thomas also filed a motion requesting Vallow and Daybell be allowed to meet with each other with both of their attorneys present.

“With settlement proposals, mediation, motions and trial fast approaching, Lori and Chad would like to be able to talk together in person and on the phone about their options,” wrote Vallow’s attorneys.

Two days earlier, Archibald and Thomas filed a notice of intent saying they would not raise a mental health defense in Vallow’s trial.

“Although still suffering from a mental illness, the defendant is taking an active role in her defense,” Archibald wrote.

On Jan. 19, District Judge Steven W. Boyce will hear motions from the defense to declare Vallow ineligible for the death penalty.

The joint trial for Vallow and Daybell starts April 3 in Boise.
